Before entering into a timeshare accommodation contract, it is important to know that this contract must contain certain mandatory information. With knowledge of this information, you can be sure that the contract is compliant and that the merchant abides by all of the prescribed rules.

Certain rules govern the payment of your timeshare accommodation rights.

First payment

The merchant may not demand or accept payment before the expiry of the 10-day deadline you are granted to cancel the contract.

Annual instalments

The merchant must collect payment from you in approximately equal annual instalments.

The annual instalments must appear in a payment schedule that the merchant is required to give you. The payment schedule must include the total amounts to be paid annually as well as the dates of the instalments.

The merchant may not demand payment of more than one instalment per year.

Statement of account

The date of the annual instalment indicated in the payment schedule is coming up? The merchant is required to send you a statement of account at least 21 days before that date. The statement of account must indicate the amount owing and, if applicable, the date on which you are required to pay this amount.

The statement of account can be sent to you by mail or by email, if you have so authorized the merchant.

Credit contract

Merchants may not require that you enter into a credit contract, either with them or another merchant, when entering into a timeshare accommodation contract with them.

Before signing a timeshare accommodation contract, find out about the cancellation terms and conditions provided for by law. You can cancel a contract entered into with a merchant who provides these types of accommodation rights at any time. Important: depending on when you cancel, you may have to pay compensation.

Any merchant who holds a draw, a contest or any other type of representation to promote timeshare accommodation rights must clearly indicate their intentions and the fact that they operate this type of business.

Have you been told that a timeshare accommodation contract is an investment? To argue such a point, the merchant must be able to prove it with a document.
