In Québec, vendors who enter into prearranged funeral services contracts and prepurchased sepultures contracts must respect specific rules of conduct. You are protected against any form of abusive solicitation.

Prohibitive actions imposed on the vendor

Unless you request it, vendors are not allowed to solicit your business:

  • by telephone;
  • in a hospital, a care centre, a residential home for seniors or any other establishment of this nature;
  • if they got hold of your name because it was on a list of persons having stayed in a hospital, a care centre, a residential home for seniors or any other establishment of this nature;
  • if you recently lost someone close to you;
  • if you are ill.

If you cancel a contract of prearranged funeral services or prepurchased sepultures or refuse to sign a contact, the vendor cannot solicit your business for one year.

Rules of home solicitation

If you would like to meet with a representative to find out about the services available, your must make this request to the representative. He must receive your authorization at least 24 hours before showing up at your home. The appointment must take place between 9:30 a.m. and 10 p.m. and must not last more than 2 hours.

The representative must provide you with all the pertinent information in a language that you understand. It is expressly forbidden for him to intimidate you or to be insistent. The representative must leave your home when you ask him to.
