The Consumer Protection Act stipulates the information contained in a contract that is entered into with an itinerant merchant:

  • your name, address and telephone number and, if applicable, your fax number and e-mail address;
  • the names, addresses, telephone numbers, and, if applicable, fax numbers and e-mail addresses of the merchant’s places of business in Québec;
  • the name of the representative that signs the contract in the name of the merchant, and his or her personal contact details (address, phone number, and, if applicable, fax number and e-mail address);
  • the permit number of the itinerant merchant;
  • the date on which the contract is made and the location where it is signed;
  • the description of the good or service and the duration of that service;
  • the price of each good and of each service and the amount of all applicable taxes;
  • the total amount that you must pay, including delivery charges;
  • the frequency and dates of all deliveries of goods and the frequency and dates of all provisions of services;
  • the date on which the last good is delivered or the last service is performed;
  • the terms of payment, where applicable;
  • the description of all goods received as a trade-in or on account, their quantity, and the price agreed for each item, where applicable;
  • the information that you can cancel the contract within ten days after having received a copy of the contract.

Other information may be mandatory based on the type of contract or the terms it contains.

The merchant must also attach the following documents to your contract:

Signature of the contract

The contract must be clearly and legibly written on paper, in French and in 2 copies. The contract may also be written in another language, if agreed upon with the merchant, once the merchant has given you the French version.

The itinerant salesperson signs the 2 copies of the contract first. Then, he must:

  • give you time to read it;
  • ask you to sign both copies, on the last page, after all the terms;
  • • give you a copy.
