An itinerant merchant may not deliver any of the services provided for in the contract, such as undertaking work or installing a product, within the 10-day period that follows the date on which you received a copy of the contract.

This rule applies because you are entitled to cancel the contract within this 10-day period.

Exceptions

In certain cases, the merchant may begin work or install a product before the end of the 10-day period.

This would be the case, for example, if the contract is for broadcasting or communications services and the products are to be installed under the terms of the contract. The merchant could, for example, install a modem before the end of the 10-day period.

A merchant could also perform an emergency repair to a door, a window or the roof of a building, if the contract only covers this work and was entered into at your home and at your explicit request.

The merchant could also deliver a service within the 10-day period by abiding with all of the conditions to be entitled to an exception regarding:

  • repairs related to heating or hot water;
  • an estimate.
