Compensation simplified
Under the Regulation respecting travel agents, travellers can receive compensation directly from the Fonds d'indemnisation des clients des agents de voyages (Compensation Fund for Customers of Travel Agents) when a carrier is no longer able to meet its obligations.
The Compensation Fund for Customers of Travel Agents simplifies travellers' recourses if a supplier like a carrier or cruise line defaults. Customers no longer need to take a travel agent to court to get payment for damages. However, they must have done business with a licensed travel agent retailing in Québec. Travellers who deal directly with a supplier are not protected by this fund.
If a travel agent has not met his obligations vis-à-vis a customer, the latter can always receive compensation or a refund from the travel agent's individual surety. If this surety is insufficient, the Compensation Fund for Customers of Travel Agents will make up the difference.
