Compensation
The Compensation Fund for Customers of Travel Agents gives you a direct refund if a supplier (e.g. airline), cruise line or hotel is no longer able to supply the services purchased through your travel agent.
Maximum refund
The previously set refund ceiling of $3,000 per person per trip has been abolished by amendments to the Regulation Respecting Travel Agents which went into effect on June 30, 2010.
The maximum compensation per incident, previously set at $3 million, now cannot exceed 20% of the Fund?s accumulated surplus as of March 31 preceding the incident. However, it cannot be less than 5 million dollars.
Simplified procedure
The Compensation Fund for Customers of Travel Agents is administered by the Office. It simplifies travellers' recourses if a supplier defaults. You no longer need to take a travel agent to court to get payment for damages.
You can apply for financial compensation by contacting the Office de la protection du consommateur.
You are not protected by the Compensation Fund for Customers of Travel Agents if you did business directly with a supplier rather than going through a travel agent with a Québec licence.
