Used car warranty
Under the Consumer Protection Act
and the Civil Code of Québec, all goods purchased from a merchant are covered by a performance warranty. It applies even if the merchant or manufacturer claims to be selling the goods without warranty or if the warranty the merchant offers on the goods (called a "conventional" or manufacturer's warranty) provides insufficient coverage.
The used car warranty is in force upon delivery and covers the parts and labour needed to ensure that the car is in good working order in the following situations:
| Factory warranty start date and mileage |
Warranty period |
| Two years or less and 40,000 km |
Six months or 10,000 km whichever comes first |
| Three years or less and 60,000 km |
Three months or 5,000 km whichever comes first |
| Five years or less and 80,000 km |
One month or 1,700 km whichever comes first |
| Over five years and more than 80,000 km |
No warranty |
Extended warranty
The merchant might offer to sell you an extended warranty. If so, be sure to get all the information you need before buying it.
Legal warranty
Although the performance warranty does not apply to vehicles over five years old with more than 80,000 km, the Consumer Protection Act
provides for some recourse if a vehicle cannot be used for its normal purpose or if a hidden defect is found. This is known as the legal warranty.
Warranty transfer
The basic manufacturer's warranty, car dealer's warranty and performance warranty are transferable when there is a change of ownership. If you buy a vehicle whose basic manufacturer's warranty is still valid, you can, if needed, demand that it be honoured regardless of whether you are the second or tenth owner.
