Explanation of contract clauses

  • In case of doubt or ambiguity, the contract is always interpreted in the parent's favour.
  • A clause referring to rules other then the terms of the daycare service contract (e.g. the daycare's in-house rules), is null and void unless these rules were brought to the parent's attention when the contract is signed. However, it applies if the daycare centre can prove that the parent was aware of them.
  • The parent can go to court to contest a contract putting him at an excessive, unreasonable disadvantage in favour of the daycare centre and seek cancellation or reduction of his obligations.
  • The daycare centre may not derogate from the provisions of the Consumer Protection Act by means of a special clause. Similarly, the parent may not renounce a right that this Act confers on him.
  • Finally, the parent always has three years after signing the contract to exercise his rights under the Consumer Protection Act if he believes that he was adversely affected by the service provider during the time the child attended the daycare centre.
