Cancellation terms
The parent may terminate a daycare service contract at any time at his sole discretion by sending the form provided for this purpose attached to the contact or any other written notice. The daycare centre may not require advance written notice from the parent, or claim fines other than those authorized by law. The contract is terminated ipso jure when the termination form or notice is sent.
Fine
- If the contract is terminated before service delivery begins, no fine may be charged the parent.
- If the termination occurs while the contract is still valid, the daycare centre may charge a fine equal to the lower of $50 or 10% of the cost of services provided for but not yet delivered.
- Example:
If, at the end of the first week, you wish to terminate a 6-week contract totalling $250, the fine will be $25, i.e. 10% of services not delivered ($250 - $25 = $225).
- If the amounts paid when the contract is terminated exceed the amount of the fine, the service provider must refund the overpayments to the parent within 10 days of the contract termination date.
