Contract with a public establishment
Contracts with certain establishments like school boards, colleges or universities are not governed by the provisions of the Act.
Contract with a private establishment
To make sure you know what you are getting, read the contract clauses carefully. By law, a contract for services involving sequential performance must contain the following information:
- your name and address and those of the merchant;
- date and place the contract was signed. To avoid problems if you decide to terminate the contract, make sure the merchant indicates the date it is signed;
- description of services offered;
- date you are supposed to be able to begin using the services (e.g. date classes start);
- address where services will be provided, which may differ from the merchant's address;
- duration of contract;
- number of hours, days or weeks over which the service are spread;
- hourly, daily or weekly rate, which must remain the same for the duration of the contract;
- total amount you will have to disburse for all of the services covered by the contract;
- terms of payment;
- any mention required by law.
This information defines the scope of your rights and obligations and those of the merchant. The latter must also attach a termination form to the copy of the contract.
